30-Day Refund Policy

We offer a 30-day refund period for unused retainer fees to ensure your satisfaction with our services.

1. Overview

At DWIGHT L. SMITH LAWYER PLLC, we are committed to providing exceptional legal services and ensuring client satisfaction. We understand that circumstances may change, and we have established this refund policy to address situations where clients may need to discontinue our services.

2. 30-Day Refund Period

You may request a refund of unused retainer fees within 30 days of your initial payment, subject to the following conditions:

  • The refund request must be submitted in writing within 30 days of the initial retainer payment
  • Only unused portions of the retainer fee are eligible for refund
  • Fees for work already performed will be deducted from any refund amount
  • Consultation fees and flat fees for completed services are non-refundable

3. Eligible Refunds

The following types of fees may be eligible for refund:

  • Unused Retainer Fees: Any portion of a retainer that has not been applied to legal services
  • Advance Cost Deposits: Unused portions of deposits for anticipated costs and expenses
  • Overpayments: Any amounts paid in excess of fees owed

4. Non-Refundable Fees

The following fees are generally non-refundable:

  • Consultation Fees: Fees for initial or subsequent consultations
  • Flat Fees: Fixed fees for completed services such as document preparation
  • Earned Fees: Fees for legal work that has already been performed
  • Court Costs and Filing Fees: Third-party costs that have already been incurred
  • Administrative Fees: Non-refundable administrative processing fees, if applicable

5. How to Request a Refund

To request a refund, please follow these steps:

  1. Submit a written refund request via email to dwightsmith@smithlawyer.us or by mail to our office address
  2. Include your full name, contact information, and case/matter reference number if applicable
  3. Specify the amount you are requesting to be refunded and the reason for your request
  4. Allow up to 10 business days for us to review your request

6. Refund Processing

Once your refund request is approved:

  • Refunds will be processed within 14 business days of approval
  • Refunds will be issued using the same payment method used for the original payment when possible
  • You will receive an itemized statement showing how the refund amount was calculated
  • A final invoice will be provided showing all services rendered and the remaining balance

7. Termination of Representation

If you choose to terminate our representation, we will provide you with a final accounting of all fees and costs. Any unused retainer funds will be refunded in accordance with this policy and applicable bar rules. We will also provide you with copies of your file and take steps to protect your interests during the transition.

8. Disputes

If you disagree with any fee charge or refund calculation, please contact us to discuss the matter. We are committed to resolving fee disputes fairly and promptly. If we cannot reach a resolution, you may have the right to seek fee arbitration through the Oklahoma Bar Association.

9. Exceptions

We reserve the right to make exceptions to this refund policy on a case-by-case basis at our sole discretion. Any exceptions granted do not constitute a waiver of our rights under this policy in other circumstances.

10. Changes to This Policy

We may update this Refund Policy from time to time. Any changes will be posted on this page with an updated revision date. Your continued use of our services after any changes indicates your acceptance of the updated policy.
